AGREEMENT FOR MINOR PARTICIPANT

Parent/Guardian Acknowledgment of Risk and Indemnity Agreement

Releasees: Offshore Acres, Nicholas L. Hill, Brittany E. Hill, and their heirs, executors, administrators, employees, agents, volunteers, and assigns.

Part A: Parent/Guardian's Acknowledgment of Risk and Authority

I, the undersigned Parent or Legal Guardian, on behalf of myself and my Child, hereby confirm, acknowledge, and agree to the following:

Scope of Activities: I consent to my Child's participation in, observation of, or proximity to any and all activities at Offshore Acres (the "Activities"), which may include, but are not limited to: equestrian activities (riding, handling, grooming, tacking), use of facilities (arenas, barns), interacting with any animals (horses, dogs, livestock), and observing or participating in lessons, clinics, or dog training events.
Acknowledgment of Inherent Dangers: I understand that these Activities are inherently dangerous and involve numerous risks of property damage, serious injury, or death, including but not limited to 1:
- Animal Behavior: The unpredictable nature of horses, which may, without warning, buck, stumble, rear, kick, bite, spook, or bolt
- Equipment Failure: The potential failure of tack, gates, fences, or other equipment.
- Environmental Hazards: Uneven or slippery ground, poor footing, weather conditions, and wildlife.
- Actions of Others: The negligence or actions of other participants, handlers, or spectators.
- Canine Activities: Risks associated with the presence of dogs on the property, including dog bites.
Assumption of Risk: I have explained these risks to my Child, and I voluntarily assume all risks, known and unknown, on their behalf.
Mandatory Safety Equipment (Helmet & Footwear): I acknowledge and agree that 5:
- My Child is required to wear an approved equestrian helmet (ASTM, BSI, or European Safety Standards) at all times while mounted or lunging a horse, in accordance with the Horse Riding Safety Act, 2001.
- My Child is required to wear hard-soled footwear with a heel of no less than 1.5 centimetres while riding or handling horses.
- I will ensure my Child's full compliance with this mandatory policy. I understand there are no exceptions.
Spectator Risk: I understand that this agreement applies at all times my Child is on the property, even if they are present only as a spectator and not actively participating in an Activity.
Rules and Conduct: I agree that my Child will follow all posted signs, rules, and verbal instructions given by Offshore Acres staff. I understand that failure to comply may result in removal from the property.
Emergency Medical Treatment: I hereby authorize the Releasees to obtain emergency medical care for my Child in the event of an accident or illness, and I agree to be financially responsible for all costs associated with such medical care and/or transport.
Legal Authority: I certify that I am the legal Parent or Guardian of my Child and have the full authority to sign this Agreement on their behalf.

Part B: Parent/Guardian's Indemnity Agreement

PLEASE READ CAREFULLY. THIS SECTION CREATES A FINANCIAL OBLIGATION FOR YOU.

I understand that under Ontario law, I may not be able to legally release my Child's right to sue in the event of an injury.

Therefore, IN CONSIDERATION of my Child being permitted to participate in the Activities and use the property of the Releasees:

I, the undersigned Parent or Legal Guardian, on behalf of myself, my heirs, executors, and assigns, hereby agree to INDEMNIFY AND HOLD HARMLESS the Releasees from any and all claims, demands, actions, or causes of action, including those for negligence, which are brought by, or on behalf of, my Child, and which arise from or relate to my Child's participation in the Activities or presence on the property.

I further agree to indemnify (reimburse) the Releasees for any loss, liability, damage, or cost (including legal fees) they may incur as a result of any such claim, demand, or lawsuit brought by or on behalf of my Child, even if the claim arises from the negligence of the Releasees.

Part C: Governing Law and Severability

This Agreement shall be governed by the laws of the Province of Ontario. If any portion is held invalid, the remainder shall continue in full legal effect. Any dispute shall be resolved exclusively in the courts of Ontario, within the County of Grey.

My Acknowledgment:

I confirm that I am 18 years of age or older, and I have read and fully understand this entire document, including the Indemnity Agreement in Part B. I am aware that by signing this, I am not releasing my Child's right to sue, but I am making a binding contractual promise to personally pay for any legal claims or damages that result from a lawsuit brought by or on behalf of my Child.9 I sign this agreement freely and voluntarily.
