Offshore Acres General Liability Waiver (For Adults 18+)


RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
(For All Activities and Use of Property)

Facility: Offshore Acres (Nicholas L. Hill & Brittany E. Hill, General Partnership)

PLEASE READ CAREFULLY BEFORE SIGNING.

By signing this document, you are giving up certain legal rights, including the right to recover damages in case of injury, death, or property damage, even if caused by the negligence of the Releasees.

  1. The Parties

I, the undersigned (the “Releasor”), on behalf of myself, my heirs, executors, administrators, and assigns, hereby enter into this Agreement with Offshore Acres, a registered General Partnership (Business Identification Number 1001112923), operated by Nicholas L. Hill and Brittany E. Hill, and their heirs, executors, administrators, employees, agents, volunteers, and assigns (collectively referred to as the “Releasees”).

  1. Acknowledgment of Risk and Scope of Activities

I acknowledge that I am voluntarily present on the premises of the Releasees to participate in, observe, or otherwise be in proximity to activities (the “Activities”), which may include, but are not limited to:

    • Equestrian activities (riding, handling, grooming, tacking, lunging, feeding, turning out, and stable work);
    • Use of any facilities (arenas, barns, wash stalls, tack rooms, trails, fields, or open spaces);
    • Interacting with horses, dogs, livestock, or other animals on the property;
    • Participating in or observing lessons, clinics, workshops, or recreational events;
    • The use of tools, equipment, or machinery, and exposure to vehicles on the property.

I understand that these Activities are inherently dangerous and involve numerous risks of property damage, serious injury, or death, including but not limited to:

    • Animal Behavior: The unpredictable nature of horses, which may, without warning, buck, stumble, rear, kick, bite, spook, bolt, or run, regardless of their training or temperament.
    • Equipment Failure: The potential failure of tack (saddles, bridles, halters, leads), gates, fences, or other equipment, whether owned by me or provided by the Releasees.
    • Environmental Hazards: Uneven or slippery ground, poor footing, holes, rocks, debris, weather conditions (ice, snow, rain, wind), and encounters with wildlife.
    • Actions of Others: The negligence or actions of other participants, riders, handlers, trainers, spectators, or staff.
    • Canine Activities: Risks associated with the presence of dogs on the property, including dog training, dog interactions, or dog bites.

  1. Assumption of All Risks

I voluntarily and fully assume all risks, both known and unknown, associated with being on the property of Offshore Acres or participating in any Activity thereon.

This assumption of risk includes, but is not limited to, all risks arising from:

(a) The inherent dangers of equestrian and other farm activities;
(b) The condition of the property, facilities, or equipment;
(c) The acts of other persons or animals; and
(d) The NEGLIGENCE of the Releasees, as defined in Section 4 below.

  1. Release of Liability

In consideration for being permitted to enter or use the property, I hereby RELEASE, DISCHARGE, AND AGREE NOT TO SUE the Releasees (Offshore Acres, its owners, employees, agents, and volunteers) from any and all liability, claims, demands, or causes of action that I may hereafter have for any injury, death, or property damage sustained while on the premises or participating in any Activity.

This release extends to all claims arising from ANY CAUSE WHATSOEVER, including, but not limited to:

    • NEGLIGENCE on the part of the Releasees;
    • BREACH OF CONTRACT on the part of the Releasees; or
    • BREACH OF ANY STATUTORY DUTY OF CARE, including any duty of care owed under the Occupiers’ Liability Act (Ontario).

I understand that negligence includes the failure of the Releasees to take reasonable care to safeguard or protect me from the risks, dangers, and hazards of the Activities.

  1. Indemnity and Hold Harmless

I agree to INDEMNIFY AND HOLD HARMLESS the Releasees from any and all claims, demands, actions, or proceedings, and any loss, liability, damage, or cost (including legal fees) that may result from my actions or participation in the Activities, or from any claim made by a third party in connection with my presence or use of the property. This includes, but is not limited to, claims brought by any guest I bring onto the property.

  1. Mandatory Safety Equipment (Helmet & Footwear)

I acknowledge and agree that:

    1. All riders, regardless of age, are required to wear an approved equestrian helmet (ASTM, BSI, or European Safety Standards) at all times while mounted or lunging a horse.
    2. All persons are required to wear hard-soled footwear with a heel of no less than 1.5 centimetres while riding or handling horses, as required by the Horse Riding Safety Act, 2001 (for those under 18) and as a mandatory safety policy of this facility (for all adults).
    3. I agree to abide by this policy, and I understand that failure to do so will result in my immediate removal from mounted activities. This policy is mandatory and no exceptions will be made.

  1. Spectators and Non-Participants

This Agreement shall apply to me at all times while on the property, even if I am not participating in an equestrian activity and am present only as a spectator, parent, or guest. I understand that risks exist simply by being on the property.

  1. Medical Treatment

I hereby authorize the Releasees to obtain emergency medical care for me in the event of an accident or illness, and I agree to be financially responsible for all costs associated with such medical care and/s-transport.

  1. Governing Law and Severability

This Agreement shall be governed by the laws of the Province of Ontario. If any portion is held invalid, the remainder shall continue in full legal effect. Any dispute shall be resolved exclusively in the courts of Ontario, within the County of Grey.

  1. Acknowledgment of Understanding

I confirm that I am 18 years of age or older, and I have read and fully understand this document. I am aware that by signing it, I am waiving significant legal rights, including the right to sue the Releasees for ordinary negligence. I sign this agreement freely, voluntarily, and without inducement.
